Terms of Service

1. Parties and acceptance

These Terms of Service (“Terms”) are between Starlight Internet Technology Co., Limited (“Farvis”, “we”, “us”) and the person or entity using Farvis. Our registered address is RM03, 24/F, HO KING COMM CTR, 2-16 FAYUEN ST, MONG KOK, HONG KONG. Contact: starlightinternet@yeah.net.

You must have legal capacity to enter into a contract. If you use Farvis for an organisation, you represent that you are authorised to bind it. By creating an account or using the service after these Terms take effect, you agree to the version presented to you.

2. The service

Farvis provides AI-assisted creation and management of scripts, images, audio, voices, avatars and videos. AI outputs may be inaccurate, incomplete, similar to third-party material or unsuitable for a particular purpose. You must review outputs before publication or reliance.

We may change, suspend or discontinue features where reasonably necessary for security, law, maintenance or product operation, subject to any separate written enterprise agreement.

3. Accounts and security

You must provide accurate information, protect your credentials and promptly report suspected unauthorised access. You are responsible for activity under your account except to the extent caused by our failure to use reasonable security measures.

We may restrict or suspend access for security, suspected fraud, non-payment, unlawful activity or material policy violations.

4. Your content, permissions and AI output

You retain the rights you hold in content submitted to Farvis. You grant Farvis and its service providers a limited licence to host, copy, transmit, transform and process that content only as needed to provide, secure and support the service, comply with law and enforce these Terms.

You represent that you have all rights, notices and consents required for submitted content, including copyright, privacy, publicity, biometric, voice and likeness permissions. You must not clone or depict another person without valid authority.

Farvis does not use Customer Content to train generative models unless a separate, explicit opt-in is offered and accepted. Subject to applicable law and third-party rights, you own output generated for you. Farvis retains all rights in the service, software, models, templates and documentation.

5. Acceptable use and content review

You must comply with the Acceptable Use and Content Moderation Policy and the AI Content, Likeness and Voice Consent Policy.

Farvis may automatically inspect inputs and outputs, hold content for review, block generation or delivery, restrict features, preserve evidence required by law, and suspend or terminate accounts. Eligible users may appeal through the published review process.

6. Third-party services

Farvis uses contracted providers for hosting, storage, payments, AI generation, digital-human processing, messaging and security. Their processing is described in the Privacy Policy and Subprocessor List.

Third-party services that you independently connect or control may have separate terms, and Farvis is not responsible for those independently controlled services.

7. Fees, credits and payments

Prices, currency, taxes, included usage and payment timing are displayed at checkout or in a separate written order. Credits are service-use units, not stored value or legal tender, and are subject to the displayed expiry and consumption rules.

Refunds, cancellations, failed payments, chargebacks and disputes are handled under the Refund, Cancellation and Dispute Policy and any mandatory consumer law.

8. Privacy and confidentiality

The Privacy Policy explains how Farvis handles personal data. Each party must protect the other party’s non-public information using reasonable care and use it only for the service relationship, except where disclosure is required by law.

9. Suspension, termination and data handling

You may stop using Farvis and submit an account-deletion request. We may terminate access for material breach, unlawful use, repeated policy violations, serious security risk or non-payment.

After termination, data is deleted or anonymised under the Privacy Policy, subject to backups and legitimate retention for billing, fraud, security, disputes and legal obligations.

10. Disclaimers and liability

To the extent permitted by law, Farvis is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness, non-infringement and uninterrupted or error-free operation. Nothing excludes rights that cannot lawfully be excluded.

To the extent permitted by law, neither party is liable for indirect, incidental, special, punitive or consequential loss. Farvis’s aggregate liability will not exceed the greater of fees paid for the affected service during the twelve months before the event or HKD 800. These limits do not apply where exclusion is prohibited by law, or to fraud, wilful misconduct, death or personal injury caused by negligence.

11. Changes to these Terms

We may update these Terms. We record the version and effective date, provide reasonable notice of material changes and request renewed acceptance where required.

12. Governing law and courts

These Terms and any non-contractual obligations arising from them are governed by the laws of Hong Kong. The courts of Hong Kong have exclusive jurisdiction, except that either party may seek urgent injunctive relief in any competent court.
